So I am driving my gf home from work and we see (and hear, quite clearly) this guy in a GMC suv (a 97-05 model, forget what) freaking out on this girl... like totally going insane yelling at her. So I pull around and drive past him and stop about 20 feet ahead (he is going maybe 5kph, the speed when you are in D). I didn't cut him off, and I signaled 100% properly... and he stops for a second or three (15-20 feet behind me) then lets off the brakes and rear ends me (maybe 5kph). So I am like what the fuck, this guy just hit me... leaves a scratch, a minor buff that you can hardly see at all however and a small 1cm tall/1cm deep cut at the wheel well (so really nothing...) but I call the cops and they come and I explain everything but all I get was "You are the one who changed lanes, your fault"... wtf?

So the guy offers to fix it and leaves his number but what if when I go there (a reputable dealership he claims to work at) he is like, oh well now I am going to try to press charges on you...? He did however say he did not wish to press any chargers or try to get me a ticket (told the cop not to).

Also, to elaborate... he caused such a scene, that a few minutes after we stop a bunch of big guys come walking by looking for some dude who is beating up his gf... So I wasn't just imagining the severity how it seemed to be.

What do you guys think?

Well, it depends. In Massachusetts if you hit someone from behind you are always at fault, no matter what. I'm not sure about the rules where you live. I would say that if it went down as you describe, then he was probably at fault. But if you passed him illegally, or cut in front of him too abruptly, probably you are. But if it's such a minor scratch, what's the big deal? Why bother to fix it at all?

Basically in most states (except not at fault) you're at fault if you rear end someone. Mixed with the road rage he was clearly having, I'd have gone through insurance and said fuck that guy.

Yeah our law states that you're the ass if you rear end someone. That gets dodgy in some scenarios, but yeah. Makes it nice and simple.

Him... if you past him and gave at least 2 car lengths at that speed, than he had adequite time to come to a stop. My question is: were there any other witnesses to the accident?

To the accident, no... but that is exactly my thought process. I am not going to pull out my driver's hand book and see how to properly stop someone who is freaking out on their girlfriend/some chick. But as I said, me and my gf saw him stop, and it was like I wasn't even there.

In Ontario, you are allowed to switch lanes (lol) but you aren't allowed to cut someone off and stop (which I never did) and going in the area of 5kph... leaving roughly 2-3 car lengths is adequate and given the situation I would warrant my stopping as reasonable (if you have to stop, you have to stop... it would be like saying "oh he stopped at a red light and I hit him... but he switched lanes because he didn't want to turn any longer and left several car lengths in between... but I was too busy screaming at my gf!")

Traffic laws aside, it sounds to me like you have won the moral victory here, at least.

Dan is a Canadian. Stop bringing American law in, it doesn't apply.

We've got a small claims court here in Ontario Dan. If he doesn't pay up then take him there. Your only problem is that the police are being dumb, and he might call them as witnesses.

Obviously everything depends on the specifics of local regulations. But give me a break. I sincerely doubt that American and Canadian traffic laws are that radically different. This may come as a shock to you, but we have small claims court here too, Haf.

But this probably isn't worth pursuing if the damage is as insignificant as Dan describes. It's frustrating, especially when you feel like you're right and deserve justice. But part of growing up is realizing when to fight and when to cut your losses. Sometimes you're better off settling for a moral victory.

In the United States, traffic laws are regulated mainly by the individual states, and vary quite a bit. Here in Canada, it's ... the same. We have provincial Highway Traffic Acts, and they're fairly dissimilar.

I mean, the basic stuff is the same: don't speed, use turn signals, stop for red lights, but the details of things like "it's always your fault when you rear-end someone" vary.

Also, the reason I mentioned the small claims is because not all Canadian provinces have one. Ontario does, yay. And generally the procedure is pretty quick with small claims; it's usually worthwhile because the cases get handled much faster than going to the superior courts.

I'm starting to think a moral victory is the best I'm going to hope for in what I have dubbed the Explorer Crisis.

Crysis:Explorer

A really cool first person shooter where Jorost dons a Crynet systems nanosuit and proceeds to beat up on sleaze bag dealers everywhere. Great graphic effects and close combat scenes. 5 stars.

I can't get past the third boss. He has a katana in his office and I forgot to pick up the crow bar after you break into the municipal center. Does anyone know how to beat him using fists. Also, I ran out of first aid kits so I can't heal my guy

Oh the third boss is easy. You sit outside the office on the phone tower and use strength mode to hurl stones in through the front window until he gets angry and comes outside. Then you jump on him. Splat!

As for health packs, put in the Konami code. :awesome:

Ok thanks. I found a health upgrade in the desk inside the building so now I can kill NPC's with ease.
